Terms & Conditions of Use Agreement

                    Please read the following Terms & Conditions for the use of this website.   If you do not agree with these Terms & Conditions, please do not use this website.  T-SWAP reserves the right to update or change these Terms & Conditions at any time without notice to users.  Please check these Terms & Conditions and the website for changes. Continued use of the website after changes have been made will constitute binding acceptance of such change(s).  You agree that T-SWAP shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.

                     All members of T-SWAP must be at least 18 years of age.  If you are not at least 18 years of age or cannot enter into legally binding contracts, please do not use the services of T-SWAP.

          T-SWAP is a venue for introducing individuals and businesses to each other for the purpose of trading or swapping items or services. 

          In order to use the T-SWAP Website, you must register as a Member of the Website and agree to be bound by these Terms & Conditions.  To access the Website for T-SWAP you must have the ability to access the World Wide Web.  It is your responsibility to obtain access to the World Wide Web.

          When you register, you must provide accurate, truthful, current and complete information about yourself as requested by the registration form.  You must update your personal contact information to keep it current and complete.  If you provide any information that is untrue, inaccurate, inappropriate, not current, or if T-SWAP reasonably believes the information to be untrue, inaccurate, inappropriate or not current, T-SWAP has the right to disable or terminate your account and refuse to allow you access to the site.  Upon registration you shall provide credit card number and expiration date and other requested billing information and allow T-SWAP to share your data with third parties for the purpose of verifying the information you provided and billing your credit card or otherwise charging your account.

          Upon registration, you will receive an account designation and password that is associated with your new account.  You are solely responsible for maintaining the confidentiality of your account and password, and are fully accountable for all activities that occur under your account.  You also agree to immediately notify T-SWAP of any unauthorized use of your account or any other breach of security.

          Because T-SWAP is not involved in the actual transactions between Members and cannot assure Members that information provided is true or accurate, T-SWAP advises that individuals and business who use T-SWAP exercise caution when dealing with unknown people or businesses.

          T-SWAP MAKES NO GUARANTIES AS TO QUALITY OF PRODUCTS OR SERVICES TRADED OR SWAPPED BY MEMBERS. T-SWAP CANNOT GUARANTEE THAT A TRADER WILL ACTUALLY COMPLETE A TRANSACTION.  T-SWAP HAS NO CONTROL OVER THE QUALITY, SAFETY, OR LEGALITY OF THE ITEMS ADVERTISED, THE ACCURACY OF THE LISTINGS, OR THE ABILITY OF EITHER TRADER TO TRADE THEIR SERVICES OR ITEMS.  

          T-SWAP DOES NOT WARRANT THIS WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS WEBSITE OR THE SERVES THAT MAKE THIS WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

          NO ADVICE OR INFORMATION OBTAINED BY YOU FROM OUR PERSONELL OR THROUGH THIS WEBSITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY PROVIDED FOR IN THIS AGREEMENT.

          ALL CONTROVERSIES BETWEEN MEMBERS SHALL BE RESOLVED BY THE MEMBERS.  THE MEMBERS AGREE THAT T-SWAP SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY ACTION OR DAMAGES WHICH MAY ARISE FROM ANY TRANSACTIONS BETWEEN MEMBERS.

          T-SWAP may provide sample contracts to Members for them to modify and use for transactions.  T-SWAP does not warrant the enforceability of any sample contract used by a Member.  Members are encouraged to seek their own legal representative to ascertain the legality and enforceability of the contract as used in the jurisdiction of the Member(s).

          Unless otherwise specified, T-SWAP grants you a non-exclusive, non-transferable, limited right to access, use and display this website and the material provided hereon, and the fee based services that you subscribed to, for you personal, noncommercial use, provided that you comply fully with the provisions of this Agreement.  You agree not to assign, transfer or sublicense your rights as a registered Member of this Website.  You understand that only you may use your user account and password, and that your subscription may not be shared with others.  Failure to abide by the foregoing terms may result in termination of your account and refusal of any refund.  Members must promptly inform T-SWAP of apparent breaches of security, such as loss, theft, or unauthorized disclosure or use of any ID or password.  Until T-SWAP is notified by email of such breach, the Member will remain liable for any unauthorized use of the service.

All videos submitted by T-SWAP.COM members or all videos taken by an approved personnel of T-SWAP.com for a T-SWAP.COM member shall become the sole property of T-SWAP.COM.  The member relinquishes all rights and ownership of the video submitted.  T-SWAP.COM has the right to deny any utilization of a submitted video by a member if he or she decides to use the video for other like or similar web sites.

          Individuals ($3.95 RATE) who join shall have a thirty (30) day free trial as a Member without having to pay any membership fee.  If you cancel membership before the expiration of thirty (30) days there will be no charge to your account.  If you continue your membership beyond thirty (30) days, you will be charged the amount stated in the registration form for the level of service you selected.   After expiration of the thirty (30) day free trial period, the term of your membership shall be month to month.  You may terminate your membership at any time with proper written notice or email to customer service.  The notice of termination shall include the name and account number.  Upon termination, you will be responsible and liable only for the full fee for the month in which you terminated your membership.  There is no proration of the fee and no penalty for termination.

          You understand and agree that no adult or offensive material of any kind is permitted to be listed or traded on T-SWAP.  Although T-SWAP will make every effort to remove such material from its databases upon notification that such items exist, T-SWAP does not guarantee nor is T-SWAP responsible for the removal of such material.   Offensive material shall include but is not limited to:  material that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; provides material that exploits people under the age of 18 in a sexual or violent manner; or provides instructional information about illegal activities.

          You must use T-SWAP in accordance with any and all applicable laws and regulations.  You agree that in the event of a dispute with T-SWAP by either party, to submit the matter to binding mediation or arbitration with the AAA.  Any and all legal action shall be brought in Fulton County, Georgia. The Member specifically agrees to such jurisdiction and waives any objection to venue or jurisdiction in Fulton County, Georgia.

          You are solely responsible for your transactions and interactions with other T-SWAP members.  T-SWAP reserves the right, but has no obligation, to monitor disputes between you and other Members.  Further, you acknowledge that the items and services they give or receive may be subject to federal, state or local income or sales taxes.  Member is responsible for determining if such taxes pertain to their situations and for payment of such taxes if applicable.  T-SWAP shall not be responsible for notifying Members of such taxes, collecting such taxes on behalf or Members, or remitting such taxes to the appropriate authorities.

          T-SWAP may, but is not obligated to, establish service ratings for Members to reflect the quality of Members’ services and transactions as reported by other Members. The service ratings may be disclosed for the benefit of Members in choosing to engage in transactions with other Members.  

          As part of the service T-SWAP provides to our Members, T-SWAP may communicate via email and other means to inform you of enhancements or changes in offerings, services, or other relevant information targeted to your interests.  Details of these communication efforts are noted with the Privacy Policy.  Members have the option to remove themselves from various e-mail communications by following the conditions listed within the message or by following the procedures as noted in the Privacy Policy. T-SWAP reserves the right to discontinue such communications at its discretion with or without notice to the Members.

          All trademarks, service marks, and trade names are proprietary to T-SWAP or other respective owners that have granted T-SWAP the right and

          You expressly understand and agree that T-SWAP shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any other damages whatsoever, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages); arising out of, or resulting from the use or inability to use this website, the use of any content or other material on this website or any website or websites linked to this website.  In no event shall our total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you, if any, for accessing this website. If you are dissatisfied with any portion of our website, or with any provision of this agreement, your sole and exclusive remedy is the discontinuation of  site
